By purchasing at www.Ceramic-Spikes.EU, you conclude with BETA 1292, s.ro. contract. These BC determine the content of this contract for us.

By creating an order (e.g. by clicking on the button to complete the order), these BC become binding for you.

How you can shop at www.Ceramic-Spikes.EU

You can buy at www.Ceramic-Spikes.EU. The order is created at the moment of clicking the button intended to complete the order. Until then, you can freely edit your order in the basket, including the method of transport and payment. The contract is only concluded when we confirm your order. You will receive an order confirmation to the e-mail address you have chosen, therefore we ask you to check the correctness of the data you have entered.

Changes to the order are possible only by mutual agreement, or under the conditions set by law or these BT).

Orders via the e-shop www.Ceramic-Spikes.EU can be made24/7. We do our best to avoid outages, but in exceptional cases they cannot be completely avoided. In the event of a failure of the ordering system or force majeure (e.g. power outage), we are not responsible for the incompleteness of the order.

Subsequent changes to the order are possible only by mutual agreement, or under the conditions set by law or these BT.

You can also order via e-mail and phone. In the case of ordering via e-mail, the contract is concluded when the order confirmation is delivered to your e-mail. When ordering by phone, the contract is concluded at the moment of your confirmation. BETA 1292, s.r.o. reserves the right of ownership of the item in case of purchase in any way until the moment when the entire purchase price has been paid by you.

Delivery of goods

Once the contract has been concluded, www.Ceramic-Spikes.EU will deliver the selected goods to you in the chosen manner and you must allow such delivery and take delivery of the goods. Together with the goods, we will also supply you with other documents that relate to the item. If you have chosen delivery to the address or pick-up point of one of our transport partners. We will hand over the goods to the carrier, who will ensure their delivery in the manner chosen by you at the specified time. Until the moment when the goods are delivered and handed over to you, or until the moment when you refuse to accept the goods, you bear the risk of damage to the things of www.Ceramic-Spikes.EU.

You will be informed about the estimated time and other information regarding the delivery method you have chosen via your specified e-mail address. The estimated delivery time may change depending on the logistics capabilities of the carrier. In case of force majeure or system failure, www.Ceramic-Spikes.Eu is not responsible for delayed delivery of goods. During collection, you should check whether the number of goods you ordered has really been delivered to you. You should also check whether the package is already visibly damaged, dented or otherwise deformed. If the package is damaged, you have the right not to accept the goods, or to accept the goods and record its condition in the handover protocol together with the carrier. Then send such a log together with a description of the defect in the shipment of goods by e-mail to the address spikes@Ceramic-Spikes.EU.

Withdrawal from the contract

You have the right to return the goods within 14 days. You must return the goods undamaged, undamaged and without signs of use. You should try on and inspect the goods in the same way as you would in a regular brick-and-mortar store. If the goods show signs of wear or other use, we may reduce the purchase price by compensation for the reduction in value of the goods resulting from such treatment before returning them. Once you withdraw from the contract, you must return the goods no later than 14 days from the withdrawal from the contract. You return the goods at your own expense, which will not be reimbursed to you. The goods should be undamaged, unused and clean. If possible, the goods should be returned in their original packaging.

What if you return damaged, scratched or otherwise worn goods

If you return damaged, scratched or otherwise worn goods, we may reduce the purchase price of the goods you are returning by an amount corresponding to such wear and tear.

Refund of money

The money will be returned to you within 14 days of withdrawal from the contract in the same way as the payment was made. However, we do not have to refund you until you return the goods or until you prove that the goods have been dispatched. You also have the right to a refund of the money spent on the delivery of the goods when ordering them, but only up to an amount equal to the cheapest method of delivery of the goods offered on www.Ceramic-Spikes.EU.

When purchasing as an entrepreneur (IČO), you do not legally have the right to return the goods within 14 days. The law favors only consumers in this respect. However, we allow entrepreneurs to withdraw from the contract under the same conditions as consumers. Therefore, if you purchased as an entrepreneur, you can withdraw from the purchase within 14 days according to the rules stated above. In case of withdrawal from the contract, the same rules apply to you as an entrepreneur as in the case of a consumer.

In what cases can www.Ceramic-Spikes.EU withdraw from the contract

In some cases, we also have the right to withdraw from the contract. This is especially the case in the case of incorrect pricing of the goods, when the price is clearly disproportionate. In case of incorrect pricing, www.Ceramic-Spikes.EU has the right to withdraw from the contract. In this case, www.Ceramic-Spikes.EU will cancel the order.

If you have already paid the purchase price of the goods, this amount will be returned to you in the same way no later than 14 days from the day following the withdrawal from the contract.

Payment, refunds, billing information

You can pay by credit card or bank transfer in our e-shop. If for any reason you subsequently request a refund of the purchase price of this item, this price can only be refunded in the currency indicated on the invoice for the item (usually in Czech crowns) and in the amount indicated on the invoice.

Until the full payment of the purchase price, the goods are still owned by www.Ceramic-Spikes.EU (so-called retention of title).

Unfortunately, the data on the invoice cannot be changed after the order has been sent.

Refunds in the event of withdrawal from the contract

If you withdraw from the contract or receive a refund for another reason, we will refund you in the same way as we received it from you.

Prices

Prices are given in CZK/CZK and are final (www.Ceramic-Spikes.EU is not a VAT payer). The price of the goods does not include the shipping cost, which will only be displayed at the last stage of the order.

Safety

Regarding the protection and processing of your data as a buyer, www.Ceramic-Spikes.EU complies with the standards of Act 110/2019 Coll. Personal Data Processing Act. As a buyer, you must protect your customer account credentials. BETA 1292 s.r.o. is not responsible for misuse of your access. responsibility.

Final provisions

Relationships and any disputes that arise on the basis of the contract will be resolved exclusively according to the law of the Czech Republic and will be resolved by the relevant courts of the Czech Republic. The UN Convention on Contracts for the International Sale of Goods (CISG) in accordance with Art. 6 of this convention shall not apply.

The contract is concluded in the Czech language. If there is a translation of the text of the contract for the buyer's needs, it applies that in the event of a dispute about the interpretation of terms, the interpretation of the contract in the Czech language applies. The contract is archived in the internal system for at least three years from its conclusion, but no longer than for the period according to the relevant legal regulations, for the purpose of its successful fulfillment and is not accessible to third parties. www.Ceramic-Spikes.EU will provide the customer with access to the contract.

Nákupem na www.Ceramic-Spikes.EU uzavíráte s BETA 1292, s. r. o. smlouvu. Tyto OP stanovují obsah smlouvy.

Vytvořením objednávky (např. kliknutím na tlačítko, kterým objednávku dokončujete) se pro vás tyto OP stávají závazné.

Jak můžete nakupovat na www.Ceramic-Spikes.EU

Nakoupit lze na adrese www.Ceramic-Spikes.EU. Objednávka je vytvořena v okamžiku kliknutí na tlačítko určené k dokončení objednávky. Do té doby můžete svoji objednávku v košíku libovolně upravovat, včetně způsobu dopravy a platby. Smlouva je uzavřena až v okamžiku, kdy vám objednávku potvrdíme. Potvrzení objednávky obdržíte na vámi zvolenou e-mailovou adresu, proto vás žádáme o překontrolování správnosti vámi zadaných údajů.

Následná změna objednávky je možná pouze po vzájemné dohodě, popřípadě za podmínek stanovených zákonem nebo těmito OP.

Objednávky přes e-shop www.Ceramic-Spikes.EU lze vytvářet nonstop. Děláme vše pro to, aby nedocházelo k výpadkům, ale výjimečně jim nelze předejít. V případě výpadku objednávacího systému nebo zásahu vyšší moci (např. výpadek elektřiny) neodpovídáme za nedokončení objednávky.

Objednávat můžete i prostřednictvím e-mailu a telefonu. V případě objednání přes e-mail je smlouva uzavřena v momentě doručení potvrzení objednávky na váš e-mail. Při objednávce přes telefon je smlouva uzavřena v momentě Vašeho potvrzení. BETA 1292, s.r.o. si vyhrazuje v případě nákupu jakýmkoli způsobem vlastnické právo k věci až do okamžiku, kdy dojde z vaší strany k zaplacení celé kupní ceny.

Doručení zboží

Jakmile dojde k uzavření smlouvy, doručí vám www.Ceramic-Spikes.EU vybrané zboží zvoleným způsobem a musíte takové doručení umožnit a zboží převzít. Společně se zbožím vám dodáme i další doklady, které se k věci vztahují. Pokud jste zvolili dodání na adresu či výdejní místo některého z našich přepravních partnerů, předáme zboží dopravci, který zajistí jeho doručení vámi zvoleným způsobem v uvedeném čase. O předpokládaném čase a dalších informacích ohledně vámi zvoleného způsobu doručení budete informování skrze vaši uvedenou e-mailovou adresu. Předpokládaný čas doručení se může změnit v závislosti na logistických možnostech dopravce. V případě zásahu vyšší moci či výpadku systému www.Ceramic-Spikes.Eu nenese odpovědnost za opožděné dodání zboží. Během přebírání zboží byste si měli zkontrolovat, zda vám byl opravdu doručen takový počet zboží, jaký jste si objednali. Dále byste měli zkontrolovat, zda balík není již na pohled poničený, promáčklý nebo jinak deformovaný. Pokud bude balík poškozen, máte právo na to zboží nepřevzít, popřípadě zboží převzít a do předávacího protokolu společně s přepravcem zaznamenat jeho stav. Takový protokol poté společně s popisem závady zásilky zboží odešlete e-mailem na adresu spikes@Ceramic-Spikes.EU.

Odstoupení od smlouvy

Máte právo vrátit zboží ve lhůtě 14 dnů. Zboží musíte vrátit nepoškozené a bez známek používání. Zboží byste si měli vyzkoušet a prohlédnout stejně, jako kdybyste tak činili v běžné kamenné prodejně. Pokud budou na zboží známky opotřebení nebo jiného užívání, můžeme ještě před navrácením kupní cenu ponížit o náhradu za snížení hodnoty zboží, které vzniklo v důsledku takového zacházení. Jakmile odstoupíte od smlouvy, musíte nám zboží vrátit bez zbytečného odkladu, nejpozději do 14 dnů od samotného odstoupení od smlouvy. Zboží vracíte na své náklady, které vám nebudou proplaceny. Zboží by mělo být nepoškozené, nepoužívané a čisté. Pokud je to možné, zboží by mělo být vráceno v originálním obalu.

Co když vrátíte zboží poškozené, poškrábané či jinak opotřebené

V případě, že vrátíte zboží poškozené, poškrábané, či jinak opotřebené, můžeme vám vracenou kupní cenu zboží ponížit o částku, která odpovídá takovému opotřebení.

Vratka peněz

Peníze vám budou vráceny do 14 dnů od odstoupení od smlouvy stejným způsobem, jakým probíhala platba. Nemusíme vám však peníze vrátit dříve, než vrátíte zboží, popřípadě, než prokážete, že bylo zboží odesláno. Rovněž máte právo na vrácení peněz vynaložených na dodání zboží při jeho objednávce, pouze však do výše rovnající se nejlevnějšímu nabízenému způsobu dodání zboží na www.Ceramic-Spikes.EU.

Při nákupu jako podnikatel (IČO) nemáte u nákupu ze zákona právo vrátit zboží ve lhůtě 14 dnů. Zákon v tomto ohledu zvýhodňuje pouze spotřebitele. Podnikatelům ale umožňujeme odstoupit od smlouvy za stejných podmínek jako spotřebiteli. Pokud jste tedy nakoupil jako podnikatel, můžete od nákupu odstoupit do 14 dnů podle pravidel uvedených výše. V případě odstoupení od smlouvy se na vás jako podnikatele užijí shodná pravidla jako v případě spotřebitele.

V jakých případech může odstoupit od smlouvy www.Ceramic-Spikes.EU

V některých případech máme i my právo od smlouvy odstoupit. Tomu je zejména v případě chybného nacenění zboží, kdy je cena zjevně nepřiměřená. V případě chybného nacenění má www.Ceramic-Spikes.EU právo odstoupit od smlouvy. V takovém případě dojde ze strany www.Ceramic-Spikes.EU ke stornování objednávky.

Pokud jste již zaplatili kupní cenu zboží, bude vám tato částka vrácena zpět stejným způsobem nejpozději do 14 dnů ode dne následujícího po odstoupení od smlouvy.

Placení, vrácení peněz, fakturační údaje

Na našem e-shopu lze platit platební kartou nebo převodem z banky. Pokud budete z jakéhokoli důvodu následně požadovat vrácení kupní ceny tohoto zboží, může být tato cena vrácena pouze v měně, která je uvedena na faktuře za toto zboží (zpravidla v českých korunách) a ve výši uvedené na faktuře.

Do doby úplného zaplacení kupní ceny je zboží stále ve vlastnictví www.Ceramic-Spikes.EU (tzv. výhrada vlastnického práva).

Údaje na faktuře nelze bohužel po odeslání objednávky měnit.

Vrácení peněz při odstoupení od smlouvy

Pokud odstoupíte od smlouvy nebo vám budou peněžní prostředky vraceny z jiného důvodu, vrátíme vám peníze stejným způsobem, jakým jsme je od vás přijali.

Ceny

Ceny uvádíme v Kč/CZK a jsou konečné (www.Ceramic-Spikes.EU není plátcem DPH).

V ceně zboží není zahrnuta cena dopravy, ta se zobrazí až v poslední fázi objednávky.

Bezpečnost

Ve věci ochrany a zpracování vašich údajů jako kupujícího www.Ceramic-Spikes.EU plní normy zákona 110/2019 Sb. Zákon o zpracování osobních údajů. Vy jako kupující musíte chránit své přístupové údaje k zákaznickému účtu. Za zneužití vašeho přístupu nenese BETA 1292 s.r.o. odpovědnost.

Závěrečná ustanovení

Vztahy a případné spory, které vzniknou na základě smlouvy, budou řešeny výhradně podle práva České republiky a budou řešeny příslušnými soudy České republiky. Úmluva OSN o smlouvách o mezinárodní koupi zboží (CISG) se v souladu s čl. 6 této úmluvy neuplatní.

Smlouva je uzavírána v českém jazyce. Pokud vznikne pro potřebu kupujícího překlad textu smlouvy, platí, že v případě sporu o výklad pojmů platí výklad smlouvy v českém jazyce. Smlouva je archivována v interním systému po dobu nejméně tří let od jejího uzavření, nejdéle však na dobu dle příslušných právních předpisů, za účelem jejího úspěšného splnění a není přístupná třetím nezúčastněným stranám.
